For the absence "Sickness", the option "Treat times recorded during absence periods as overtime" is to be activated. This means that the recorded times are counted as overtime.

However, according to the law, this is not permissible, as the employee is exempt/exempt from the obligation to work during an illness/illness. Therefore, legally no overtime can be worked.

However, this is not possible with the above-mentioned setting. But if the option is not activated, the total hours are not displayed/valued.

How is it possible to create a setting for the absence "sickness" in which entered times are not evaluated as overtime?

Bei der Abwesenheit “Krankheit” soll die Option “Während Abwesenheitsperioden erfasste Zeiten als Überstunden werten” aktiviert werden. Damit werden eingetragene Zeiten als Überstunden gewertet.

Das ist aber nach dem Gesetz nicht zulässig, da während einer Krankheit / AU der AN von der Arbeitspflicht befreit/freigestellt ist. Somit können rechtlich keine Überstunden entstehen.

Mit der o.a. Einstellung ist dies aber nicht möglich. Aber wenn man die Option nicht aktiviert, werden die gesamten Stunden nicht angezeigt/gewertet.

Wie ist es möglich eine Einstellung für die Abwesenheit “Krankheit” zu erstellen, in der eingetragene Zeiten nicht als Überstunden gewertet werden?

This won’t be possible due to the points you mentioned above. In your case, you will need to ensure that the employee does not enter hours on days in which the Sickness absence type is used. If legally, they are not obliged to work during sick leave, then I assume this incident should not happen. As Sickness is a true absence, this setting needs to be enabled to ensure the hours are deducted from the monthly goal.

This setting is the same for all absence types, therefore maybe in future due to this law we will need to change this. If you believe we can improve this setting, I would kindly ask you to enter this into our Ideation Area.
