In Austria, there is a special situation regarding parental leave that only affects mothers. The Austrian legislator differentiates between maternity protection (only valid for women) and parental leave.
Maternity protection starts 8 weeks before the due date and ends 8 weeks after childbirth. During this period, the employee is not allowed to work and receives her salary from the state (no salary paid by the comoany). However, this time is still considered part of the employment relationship, meaning that the employee continues to accrue vacation entitlement.
During parental leave, the employment relationship is actually suspended—no salary is paid, and no vacation entitlement is accrued.
Currently, there is no absence option that correctly reflects maternity protection (no salary, but vacation accrual), as the system treats the employee as if she were already on parental leave (no salary, no vacation accrual). This means that vacation accrual stops at the beginning of maternity protection instead of at the start of parental leave.
Is there a proposed solution for an absence type that leaves the vacation accrual policy unaffected and only impacts payroll?
